Minnesota Child Support Law

Minnesota has a specific set of guidelines for calculating child support. These guidelines were changed  in 2007 to consider the income of both parents and the amount of time each parent spends with the children.  The guidelines also take into account who pays for medical and dental insurance, who pays for day care, and many other factors in addition to a basic amount of monthly support. In most cases, the court will apply the statutory guidelines strictly and will require a justification for any departure from them.

Failure to Pay Child Support

Minnesota law treats child support and parenting time as two separate issues. The fact that one parent has failed to pay child support does not mean that parent is no longer entitled to parenting time. The failure to pay support is not a legally valid reason to deny or restrict parenting time.  However, there can be serious consequences for failure to pay child support as ordered by the court, including but not limited to denial or revocation of the paying party’s driver’s license, seizure of tax refunds and other collection action, even jail time for contempt of court.
