“Parenting time,” formerly called “visitation,” refers to the time each parent is entitled to spend with their children.  One parent may have “sole physical custody” but, in most cases, both parents are entitled to parenting time with their children. Parenting time is usually shared between the parties pursuant to a set schedule.

Determining Visitation Rights

Minnesota law presumes that it is in a child’s best interest to have a relationship with both parents.  Therefore, the court must grant a non-custodial parent such parenting time as will enable him or her to maintain a parent-child relationship with the child that will be in the child’s best interest.  Minnesota law presumes that, barring other circumstances, a parent is entitled to parent their child at least 25% of the time. Beyond that, parenting time schedules are negotiated by the parties based on their wishes and work schedules, children’s school and day care schedules, etc. If the parents cannot agree on a schedule, they might seek the help of a professional mediator or the decision of a parenting time expeditor.

Parenting Time Modification

People’s work schedules, family demands, and other obligations are rarely set in stone.  When one of the parents has a substantial change in their time commitments, a modification of the parenting time schedule may be necessary.
